NMAC 50-9-5a
Employer did not furnish to each of his employees, employment and a place
of employment
which was free from recognized hazards that are likely to cause death or
serious physical harm
to his employees.
1.  The employer (City of Deming) established a Fire Department by Ord.
80, 7-6-1915; amd.
2001 Code, however, the City has not complied with the mandates of Section
50-9-5(A) and (B)
of the New Mexico Occupational Health and Safety Act, 10.25.11.8 NMAC and
11.5.2 .10
NMAC
a.  The City of Deming did not ensure fire department members under its
charge have the
knowledge and skills required to maintain competency to perform in their
assigned positions.
b.  The City of Deming did not have a structured training program and
policy that ensure that
personnel are trained and that competency is maintained to effectively,
efficiently,
and safely
execute all operations consistent with the department's local
responsibilities.
c.  The City of Deming did not  ensure that firefighters are physically
and emotionally
capable of performing the specific duties which may be assigned to them by
instituting a
program of medical review.
d.  At the time of initial assignment the City of Deming  did not ensure
that each firefighter
completes the following forms or equivalents which contain the minimum
information specified
in the following:
(1)  Medical History for Firefighters Subsection L of  11.5.2.10 NMAC,
(2)  Performance Criteria for Firefighters, Subsection M of  11.5.2.10
NMAC,
(3)  Medical screening examination, performed in conformance with the
"Medical
Screening Form for Firefighters Subsection N of 11.5.2.10 NMAC
e.  The City of Deming did not ensure that the medical surveillance
required by this standard
be performed every five (5) years for firefighters below age 35, every (2)
years from ages 35
to 45, and annually after age 45.
f.  The City of Deming did not provide regular schedule training and
education for all
firefighters to maintain competency.
FEASIBLE ABATEMENT:
a.  Perform an assessment and make a determination on what emergencies
services that
will be provided by the City Fire Department to determine what training
will be required
to perform those activities.
b.  Dedicate sufficient resources to comply with the requirements outlined
in 11 NMAC
5.2.10, the National Fire Protection Association standards, State Fire
Marshal's
requirements and other applicable consensus instructions to meet at least
the minimum
requirements for firefighters
c.  Prepare comprehensive standard operating guides outlining how
emergency services
will be accomplish.
d.  Establish and manage a progressive and aggressive training program
that will
provide the necessary knowledge and experience to protect firefighters
when performing
required emergency service duties.
e.  Maintain required training and medical records that meet federal
mandates.
