Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: Employees were exposed to fall hazards in excess of 15 feet while working from and riding on a personnel platform that was set on the forks of the Ingersoll Rand rough terrain forklift (Model VR-642 S/N 153862). The following hazards were present: 1.The platform was not equipped with an adequate guardrail system. 2.Employees were not wearing any personal fall arrest equipment while installing building board and components for the four-ten unit apartment building on the site of Dublin Road Town Homes. Ground to roof peak height was approximately 25 feet. 3.Employees rode on the personnel platform to the south side of site with loose building supplies, such as multiple window frames, from the garages that were used for storage. Employees need additional training in fall protection hazard recognition. 4. Lack of an information tag on the personnel platform, certified by a mechanical engineer, that lists the maximum load, empty platform weight, and the minimum capacity of the forklift used to lift the platform. 5.The working width of the platform extended past the wheelbase by three feet on either side. 6.The personnel platform was just slid onto the forks and not securely attached to either the forks or mast to prevent the platform from sliding off the forks.
