Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to amputation hazards : (a)On or about 2/5/04, an employee suffered a severe laceration injury to his left index finger while he was performing setup and adjustment operations on the Penn Bender #2667 machine. The machine is activated via a foot control that was not guarded and the employee inadvertently stepped on the unguarded foot control while setting up the machine which caused it to cycle. Among others, one feasible and acceptable method to correct this hazard is to install a guard over the foot control to prevent inadvertent operation by the operator.
