Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falling 20-40 feet from a job made work
platform:
a) Work site, 108 Bunker Hill Rd., Swedesboro, NJ., North elevation - An
employee
was 20-40 feet above ground installing fascia boards to a residential
exterior using sheets
of plywood that were placed on the forks of a Highlander Lull rough
terrain forklift truck
without a personal fall arrest system. The sheets of plywood were not
secured to prevent
the sheets of plywood from falling off of the Highlander Lull rough
terrain forklift truck
Model# 8K-42 and the employee on the plywood was not protected from
falling off the
plywood by the use of a proper guardrail system or personal fall arrest
system. On or
about 02/25/04.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO:
1. Provide equipment designed for personnel lifting, e.g. scissor lift,
aerial lift.
2. Follow the required safety guidelines for fall protection in 29 CFR
1926.502.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE
TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29
CFR 1903.19.0
