Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an unstable Aerial Lift. a)Southeast Area Of Site: Employees were using a JLG Aerial lift as a crane to lift formwork, on or about 8/23/07. ABATEMENT NOTE: Feasible and acceptable methods for abating this hazard are: 1)Follow the manufacturer's recommendations on proper use of the equipment. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
