Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)In the reclaim area: On or about 3/18/04, and for approximately three years prior, employees were exposed to irritating solvent vapors of d-limonene which causes headaches, nausea, burning of the eyes, nose and throat because the downdraft exhaust ventilation system on the reclaim workbench was not working. Among other methods, one feasible and acceptable method to correct this hazard is to conduct peroidic inspection and testing of the mechanical components of the exhaust ventilation system and measure the flow rate or the static pressure of the system as recommended in Chapter 9 of "Industrial Ventilation, A Manual Of Recommended Practice, 23rd Edition, ACGIH" to insure that the system is working properly as designed.
