Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to carbon monoxide poisoning:
(a) Throughout facility operations, for an employee operating the HYSTER
model S40C,
serial #C2D2275K, powered industrial truck while performing service,
maintenance and
load moving operations and having exposure to carbon monoxide levels of
approximately
630 PPM.  This is approximately 3.15 times the NIOSH Recommended Exposure
Limit
ceiling value of 200 PPM.
Among other methods, one feasible and acceptable means of abatement would
be for the
employer to ensure proper maintenance is performed on the vehicle exhaust
system to ensure
carbon monoxide emissions do not exceed 200 PPM at any time or 50 PPM as
an 8-hour time-
weighted average.
