North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) at the site, the employee was observing operating a chain saw without the use of personal protective equipment to include eye, ear, face, head, leg and fall protection. Reference: Southern Chapter International Society of Arboriculture, First Edition, 2002, page 26. NOTE: Among other methods, the feasible and acceptable method to abate these hazards is to provide eye, ear, face, head, leg and fall protection. b) at the site, the employee was observing wearing a belt with snaphooks that were not of the locking type designed to prevent disengagement. NOTE: Among other methods, the feasible and acceptable method to abate this hazard is to provide locking snaphooks.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) at the site, employees were observing working along Hollis Rd. and had not implemented traffic control signs or devices per the Manual on Uniform Traffic Control Devices ("MUTCD"). Reference:Southern Chapter International Society of Arboriculture, First Edition, 2002. ANSI Z133.1-2000, section 4.4.1 Traffic Control. NOTE: Among other methods, the feasible and acceptable method to abate this hazard is to provide traffic control devices as stated by the MUTCD.
