T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the employer did not ensure that employees utilized seat belts while operating fork lifts in order to prevent crushing injuries in the event of a forklift tip over. One method of abatement: Develop and implement seat belt policy with enforcement of those policies.nt
