T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the Toyota powered industrial truck was not equipped with a seatbelt to prevent being crushed by the overhead guard in the event of a tipover. Among other methods, one feasible and acceptable method to correct the hazard associated with this item would be to install a seat belt on the powered industrial truck.rial
