North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from an unauthorized work platform: a)work site-work platform mounted on a Lull model 644D-34 did not conform to the requirements for personnel elevating platform as required in para 8.25 ASME B56.6a-1994.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls due the failure to follow the provisions outlined in the operators manual and para 5.15 ASME B56.6a-1992: a)work site-the operator of a Lull model 644D-34 did not conform to the requirements for elevating personnel as required in para 5.15 ASME B56.6a-1992.
