North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls from an elevation: a)Neuse River WWTP, waste water treatment basin - on or about 06/02/04 where an employee was using a job-made ladder, which was not secured, as a work station and the ladder tipped causing the employee to fall 16 feet. The employee was hoisting a metal bracket weighing approximately 75 pounds while standing on the ladder. REF: ANSI A.14.4-1979 para 1.3, Safety Requirements for Job-Made Ladders. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WORK FROM A WORK PLATFORM.
