North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of
North Carolina: The employer did not furnish to each of his employees
conditions of
employment and a place of employment free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees, in that
employees were exposed
to:
a)site - untrained and uncertified forklift operator was observed exiting
a forklift
which was not on level ground, but was positioned on an incline, climbing
on
top of the unattended forklift, maneuvering underneath an unsecure and
unstable load of approximately 40 pieces of 2" x 4" x 8' and other assorted
sizes of lumber,  climbing up onto the extended arm, hanging onto the
extended forks, and maneuvering between the raised load at approximately 11
feet above the lower ground level and the edge of the second story floor at
approximately 9 feet above the lower ground level while accessing the
second
story floor of a two story, single family house under construction.
One feasible and acceptable abatement method, among others, to correct this
hazard is to insure adequate and appropriate forklift operator training
IAW the
required specifications of 1910.178(l) to insure operators knowledge and
recognition of acceptable operational procedures, limitations, and hazards
associated with inappropriate and unauthorized usage of forklifts and
loads.
