North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of
North Carolina: The employer did not furnish to each of his employees
conditions of
employment and a place of employment free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees, in that
employees were exposed
to:
a)site, warehouse, throughout - multiple steel vertical support beams,
approximately 35 feet high, with 2 metal bolts for attachment to the
finished
concrete floor, including but not limited to a vertical support beam in the
vicinity of the rear garage door in the rear of the warehouse was not
maintained in a straight and rigid condition, but was displaced and twisted
approximately 30 degrees off center with a decreasing and varying degree of
twist extending up the beam to the top of the beam, and with one of the two
attaching bolts pulled several inches from its anchor point in the floor
exhibiting visible stress and twisting.
One feasible and acceptable abatement method, among others, to correct this
hazard is to replace and/or repair steel vertical support beams as
feasible
and
appropriate, install appropriate barriers and/or bumper guards around the
vertical support beams and retrain forklift operators on proper clearance
and
avoidance techniques when operating in the immediate vicinity of these
support beams.t
