Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On December 19, 2003 Dynasty Group, Inc. permitted employees engaged in survey work to be exposed to struck-by hazards from motor traffic while working in and near the traveled way of River Road without posting advance warning signs to alert approaching road users of a temporary work zone within the traveled way. Among other feasible and acceptable abatement methods to correct this hazard include the proper placement of advance warning signage. These abatement methods are discussed in detail in the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition Section 6G.03. b) On December 19, 2003 Dynasty Group, Inc. permitted employees engaged in survey work to be exposed to struck-by hazards from motor traffic while working in and near the traveled way of River Road without posting a lane closed warning sign to alert approaching road users of a lane closure within a temporary work zone. Among other feasible and acceptable methods to correct this hazard include the proper placement of lane closure signage. These abatement methods are discussed in detail in the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition Section 6F.21 c) On December 19, 2003 Dynasty Group, Inc. permitted employees engaged in survey work to be exposed to struck-by hazards from motor traffic while working in and near the traveled way of River Road without erecting traffic control devices redirecting road users from the normal path to a new path approaching the work zone. Among other feasible and acceptable abatement methods to correct this hazard include the proper placement of channelizing devices. These abatement methods are discussed in detail in the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition Section 6C.05 No abatement certification or documentation is required for this item.
