Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Employees were exposed to falling debris and a falling trash chute from
the third story of the
building due to inadequate anchorage of the trash chute supports to the
top of the building.
One possible means of abatement would be to comply with the WACO Owner's
Manual which
states in part:
1. That the installer will ensure the parapet or slab is capable of
supporting the weight of the
chute plus debris shock load. (Questions to Ask section of manual, Item
3,Front Cover)
2. Do not allow debris to accumulate inside the chute (Safety Comes First,
Item 7, page 3)
3. Requires the installation of guardrails at all openings (page 4).
4. That means are to be used to ensure the supporting structure is capable
of withstanding the
imposed load of the installed outriggers, chute sections and hoppers (Page
5).
5. That if needed, install a board behind the back brace of the parapet
outriggers to disburse the
weight or block it out to the correct thickness.  Also if needed, install
a board behind the front
braces to protect the face of the structure (page 7).
6. If additional bracing is required, it may be necessary to tie the
outriggers back with wire
cable and clamps to an adequate anchor capable of supporting the intended
loads if there are any
concerns about the supporting structure carrying the outriggers and the
chute (Page 7).
