Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to the hazard of being struck by a falling vehicle lift.
a)First Step Auto Finance located in Toledo, Ohio:  The employer failed to
ensure the
safety locking devices on the ALM Lift Model #7001A  were functioning
properly.  The
safety latches on the vehicle lift were bypassed by wedging cardboard
between the safety
lock and the frame of the vehicle lift, on or about June 2, 2004.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to ensure vehicle lift operators are instructed in the safe use
and operation of
the lift and to establish periodic inspection procedures in accordance
with ANSI B153.1-
1990, "American National Standard for Automotive Lifts- Safety
Requirements for the
Construction, Care, and Use".
No abatement certification or documentation is required for this item.
