Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: a)The Marion Steel Company located in Marion, Ohio: On or about October 18, 2004, the employer did not ensure the spreader bar used by the #3 crane was marked with the appropriate load rating. The spreader bar is used to move bundles of rebar, flat stock and angle weighing between 5000 and 9000 pounds throughout the mill. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET). Among other methods, one feasible and acceptable method to correct this hazard is to comply with the requirements of ANSI B30.20.
