Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to combustible and corrosive atmospheres from a release of
ethylenediamine at
the tanker truck unloading operation:
a.Akzo Nobel Functional Chemicals, LLC located in Lima, Ohio: On or about
July 15,
2005, the employer did not ensure employees involved in the
ethylenediamine unloading
operation were maintaining a vapor tight connection between the tanker
truck wash out
port and the vapor recovery hose. Employees were exposed to an
uncontrolled release
of ethylenediamine from a tanker truck located at the unloading station at
tank farm #3
as they were performing the unloading operation.
Among other methods, one feasible and acceptable method to correct this
hazard
is to
ensure the connection between the tanker truck and the vapor recovery hose
is vapor tight
according to NFPA 30 - 2003 "Flammable and Combustible Liquids Code",
Section
7.10.7.1 Tank or equipment openings provided for purposes of vapor
recovery shall be
protected against possible vapor release in accordance with 4.3.3.4.6,
7.6.10.6, and
7.6.10.7.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this
violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET),
and in addition, documentation demonstrating that abatement is complete
must be
included with your certification.  This documentation may include, but is
not limited to,
evidence of the purchase or repair of the equipment, photographic or video
evidence of
abatement, or other written records.
b.Akzo Nobel Functional Chemicals, LLC located in Lima, Ohio: On or about
July
15,
2005, the employer did not ensure employees involved in the
ethylenediamine unloading
operation depressurized the tanker truck prior to detaching the vapor
recovery hose from
the trucks washout port. Employees were exposed to an uncontrolled release
of
ethylenediamine from a pressurized tanker truck located at the unloading
station as they
were performing the unloading operation.
Among other methods, one feasible and acceptable method to correct this
hazard is to
ensure the tanker truck has been depressurized through the use of pressure
gages and safe
work procedures before the vapor recovery hose is detached from the tanker
truck.
No abatement certification or documentation is required for this instance.
