Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
Employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
a)  On or about January 15, 2004 and prior to that time located within or
adjacent to the St Rt
131 Newtonsville construction project, employee(s) who performed
associated work zone storm
drain construction and or flagging operations adjacent to the Caterpillar
Model 225 Hydraulic
Track Excavator were exposed to struck by and/or against hazard(s) of the
excavator's crawler
track(s), caught between hazards created within the swing radius of the
excavator body and
crawler's track(s), and/or hazards associated with being pinned or struck
between on coming non
construction traffic and the excavator.
Among other methods one feasible abatement method would include the
development and
implementation of Caterpillar Model 225 Track-Type Excavator operation and
maintenance
procedures, as well as Construction Industry Manufacturers Association
(CIMA) Hydraulic
Excavator Safety Manual for Users, Operators and Maintenance Personnel
procedures including,
but not limited to:
1) Be sure everyone is clear before swinging or moving in any direction.
2) Do not allow personnel to be in pinch areas when the machine is in
operation.
Care must be taken to prevent motion between pinch points and avoid such
area
when movement is possible.
3) Never travel a machine on a job site, in a congested area, or around
people
without signal person.  The signal person shall be responsible for
determining and
controlling speed and safety in moving.
4) Audibly signal intentions to move.
5) Never travel or swing the machine without first making certain no one
is in
endangered.
6) Use signal persons when clearances are close.
7) Reduce travel speeds when maneuvering in tight quarters.
8) Stay clear of all rotating and moving parts.
9) Clear all personnel from the machine and area when preparing to operate
the
machine.
10) The operator must be satisfied that no one will be endangered before
moving
the machine.ed
