Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: Excel Apparel Group, 3517 Frutas St., El Paso, TX 79905; for the period of time up to and including January 26, 2006. Excel Apparel Group did not furnish a place of employment free from recognized hazards. Incompatible chemicals were allowed to co-mingle in a Patterson- Kelley blender. There were no written procedures in place to provide employees with a procedure to safely blend chemicals with various properties without residues coming in contact and producing violent reactions. Abatement should address written procedures being established.
