Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a/ A trash compactor had the hopper opening point level with the container's refuse dumping floor without having a guard rail and toe board to prevent employees from falling or slipping into the charging chamber. b/ The Dial Corporation had controls for one trash compactor that were not of a design such that sustained manual pressure was required to operate the controls, and point of operation guarding was not present. c/ The Dial Corporation had controls for one trash compactor that were not of a design such that sustained manual pressure was required to operate the controls, and the point of operation guarding was such that it was not interlocked. Employees used a pole to push material into the charging chamber of the trash compactor. While ultimate responsibility for correcting the hazards rests with the employer, given his/her superior knowledge of the work place, feasible and acceptable methods of abatement to correct this hazard, among others are: 1. To follow the guidelines of ANSI Z245.1-1975 for safety requirements for refuse collection and compaction equipment, ANSI Z245.1-1984 for refuse collecting and compacting equipment, ANSI Z245.1-1992 for refuse collection safety requirements, processing and disposal equipment - mobile refuse collection and compaction equipment safety requirements, ANSI A12.1-1973 safety requirements for floor and wall openings, railings, and toe boards, and the latest ANSI/NFPA 70-1990 National Electric Codes and all as amended to provide guard rails, toe boards, interlocks and safety control switches as required by those nationally recognized safety standards. ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS VIOLATION. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
