40.1-51.1(a) of the Code of Virginia: The employer, Virginia Apple Storage Inc., did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to pinch points created when the elevator floor passed by the hoist-way openings. The Hollister-Whitney freight elevator was equipped with vertically sliding gates to protect employees from contact with pinch points. These gates were held open by vise-grips. A17.1 Safety Code for Elevators and Escalators, 204.4h Vertically Sliding Doors and Gates, requires gates to extend from a point not more than 1 inch above the floor, to the full height of the car entrance opening. One feasible method of abatement would be the removal of the vise-grips to allow the gates to function as intended.
