Section 5(A)(1) of the Occupational Safety and Health Act oF 1970: The employer did not furnish to each of his employees, employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by overturning equipment: On or about 2/4/04, on 58th Avenue, employees were exposed to the hazard of being thrown from an excavator because the employer did not require employees to use an operator restraint device. Among other methods, one feasible and acceptable abatement method is to require the use of a seatbelt. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
