Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that: employees were exposed to a crushing
hazard in the event
of a forklift tip-over or other accident, in which the use of seatbelts by
employees operating
forklifts was not enforced.
On or about 02/12/04, at 5300 Broken Sound Blvd, an employee was operating
a Teledyne
Princetone Piggyback forklift, serial number 1438, and was not wearing the
seatbelt exposing
the employee to serious injuries, in the event of a tip-over or other
accident.
One feasible and acceptable abatement method to correct this hazard is to
ensure that employees
wear seat belts when opertaing forklifts.
PLEASE NOTE:  CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.
