Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to:
a) On or about August 16, 2004 St. Andrews Club, Inc. 4475 N. Ocean Blvd.
Delray
Beach, Florida. - An Employee was straddling the top of an 8-foot
fiberglass step ladder
while trimming hedges.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is
to comply with the ANSI A14.5-1992 standard for ladders-Portable
Reinforced Plastic that
recognizes the hazard of using step ladders in ways other than those
specified for their design
ie; the top of a step ladder is not to be used as a step or a seat and
that the back sides of step
ladders are not designed for use as ladder rungs.
PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS
VIOLATION.
