Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to a fall
hazard. An employee was
trimming trees from the basket of an articulating boom truck, serial #
870899, model LR50 and
the cables snapped. The employee was ejected from the basket as the boom
moved to a lower
position.
On or about 09/22/2004 while trimming trees from the basket of an
articulating boom truck, an
employee was exposed to a fall hazard. The equipment on the truck was not
inspected to ensure
that the equipment was safe to use. The employee was allowed to work in
the basket without the
use of a safety harness.

REQUIRED FOR THIS VIOLATION.
