Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of flying debris: In the truck maintenance shop, employees were exposed to the hazards of flying shards in that the shop air, at 90 psi, was piped through this facility via Schedule 40 Poly-Vinyl- Chloride(PVC) piping. Plastic pipe is subject to failure and shattering when exposed to the pressures of compressed gasses. Among other methods, one feasible and acceptable method to correct this hazard is to encase the plastic piping in metal pipe as to protect it against atmospheric corrosion, deterioration, and external damage as required by Section 842.43 of the American National Standards Institute/American Society of Mechanical Engineers (ANSI/AMSE) B31.8-2003, Gas Transmission and Distribution Piping Systems Standard. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
