Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall hazards from the special purpose personnel elevator:
The special purpose personnel elevator located in the East Concrete Grain
Elevator did
not have fully functional electrical interlock switches or means of
locking the doors shut
while the special purpose elevator car was in motion as required by the
American Society
of Mechanical Engineers in Safety Code for Elevators and Escalators, ASME
A17.1-
1996, Rule 1501.2; Locking Devices for Hoistway Doors or Gates.  ASME
A17.1-1996
required hoistway door or gates to be provided with hoistway-door
interlocks or locking
devices and electric contacts which will prevent starting the car unless
the door or gate
is locked in the closed position.
Among other methods, one feasible and acceptable method to correct this
hazard is to
repair, replace, or re-wire the electrical contact switches that prevent
the operation of the
elevator car until the gates/doors are closed.
29 CFR 1903.19(c)(1) requires certification that the abatement of the
above violation is
completed.
