Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall hazards from the special purpose personnel elevator:
a)Employees using the special purpose personnel hand elevator located
between bins 1
through 4 did not have any gates on the ground floor to prevent employees
from being
struck by the hand elevator or fall through the opening a the top level
when the hand
elevator is not at that level.  The American Society of Mechanical
Engineers in Safety
Code for Elevators and Escalators, ASME A17.1-1996, Rule 600.6; Hoistway
Gates for
Landing Openings.  ASME A17.1-1996 requires Hoistway-landing openings to be
equipped with horizontally sliding or swinging doors.
Among other methods, one feasible and acceptable method to correct this
hazard is to
construct a gate that meets the requirements of Rule 600.6
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
b)Employees using the special purpose personnel hand elevator to access
high platforms
for maintenance were exposed to fall hazards from hand car failures.  The
special
purpose hand elevator located between bins 1 through 4 was not inspected
at the required
intervals to ensure proper operations and safety.  The American Society of
Mechanical
Engineers in Safety Code for Elevators and Escalators, ASME A17.1-1996,
Rule 1010.3;
Hand Elevators requires routine inspections shall be performed at
intervals not longer
than 6 months.
Among other methods, one feasible and acceptable method to correct this
hazard is to
conduct inspections by a qualified person at least every six months.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
