Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushed-by hazards:
The employee operating the Yale Powered Industrial Truck, on the loading
dock in
bay 1, at the jobsite of 901 N. Vanguard, McPherson, Kansas, was exposed to
crushed-by hazards.  The Yale Powered Industrial Fork Truck was not used in
accordance with manufacturers recommendation "Basic Operator Training"
page 4.
The operator of the Yale Powered Industrial Truck was not wearing the seat
belt.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD
TO CORRECT THIS HAZARD IS:
Operate the Yale Powered Industrial Fork Truck according to manufacturers
recommendation.  "Basic Operator Training Participants Guide" third
edition page 4,
"Remember! An unloaded truck can tip over more easily than a loaded truck
with the
load lowered for travel.  Never turn on a ramp!  Slow down for turns!
Wear your
seat belt!"
29 CFR 1903.19(c)(2) abatement of the above violation was verified at the
time of
inspection, no certification is required.
