Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to crushing hazards: On or about 07/22/04, at 345 Fitch Street, New Haven, CT a lull operating on uneven ground while lifting a mortar buggy 34 feet high, became unstable and tipped over on its side. Among other methods, one feasible and acceptable method to correct this hazard is with the requirements of the American Society of Mechanical Engineers standard ANSI B56.6-1992, Section 5.15, Safety standard for Rough Terrain Forklift Trucks and follow the manufacturers operating procedure.
