Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that an
employee was exposed to being struck by or caught in between the roll-over
protection
(ROPS) and the ground in the event the employee falls or gets thrown from
the machine due
to not wearing the installed seat belt.
On or about February 19, 2004 at the worksite located at Pierce Street -
West
Memphis Sr. HS in West Memphis, Arkansas the employee operating a
Catapillar
tractor, model 416C equipped with bucket and back-hoe attachments was
exposed to a
crushing injury from being caught between the roll-over protection (ROPS)
and the
ground because the installed seat belt was not being worn.
Among other methods, one feasible and acceptable abatement method to
correct
his hazard is to train/certify and inspect employees on wearing seatbelts
installed
by the manufacturer of the Catapillar Tractor.
