Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to fall hazards: On or about 04/26/04: a) Loading dock area - Employees operating Daewoo Models G25E and G20S industrial trucks were not wearing provided seat belts. Among other methods, one feasible and acceptable abatement method to correct the hazard is to develop a policy that follows all the requirements and recommendations as outlined in ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks. These requirements include, but not limited to: 1) An active operator protection device or system, when provided, shall be used. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
