Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls:
a) Lyons & Sons Warehouse, 875 Sherman Avenue, Pennsauken, NJ - Employees
were
exposed to a fall of up to approximately 16 feet when they climbed stacked
pallets of
cocoa beans to access the top of these stacks in order to drop a
fumigation tarp in place.
On or about May 13, 2004.
Feasible and acceptable abatement methods to correct this hazard include,
but are not
limited to, the following:
1. Automatic or manual tarping system.
2. Ensure that ladders are safely used to access the top of these stacks.
3. When on top of these stacks, provide a personal fall arrest system.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE
TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29
CFR 1903.19.

on the forks of a Nissan forklift, to access the tops of cocoa bean
stacks.  On or about
May 13, 2004.
Feasible and acceptable abatement methods to correct this hazard include,
but not limited
to, the following:
1.Ensure that ladders are safely used to access the top of these stacks.
2.When on top of these stacks, provide a personal fall arrest system.
