Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Cook's Landing Subdivision, Demooney Road and East Stubbs Road, On or about 3/27/04 - An employee was fatally injured while loading a Caterpillar 963 loader onto a Fontaine hydraulic flat deck trailer. The employee was not wearing the seat belt while operating the loader. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED Among other methods, one feasible and acceptable method to correct this hazard is to train all operators on the requirement to wear seatbelts while operating material handling equipment that is equipped with a seat belt.
