Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by collapsing structure while using aerial work platforms for purposes other than those intended by the manufacturer: (a) Horse Arena, 13835 Hopewell Road, Alpharetta, GA, On or about 7/26/04 - The employer was using JLG Models 33RTS and 40RTS Sizzor Lifts, tied to the rigid frame structure with WebbTech 4800 vertical chokers, to support the horse arena structure. An employee was fatally injured when the building collapsed. Hazard of collapse. Other feasible and acceptable methods to abate this hazard are for the employer to reference ANSI/SIA A-92-6-1990, Self Propelled Elevating Work Platforms and the JLG Operators and Safety Manual for the JLG 33RTS and 40RTS on the responsibilities before using the aerial platform, and to understand that the purpose for which the aerial lift is to be used is within the scope of the manufacturer's intended application. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIREDATION
