Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
(a) On or about September 29, 2004, initial Clearing Transmission Project
west of
Arnold Road in Fairmount, GA - An employee was behind a bulldozer when it
rolled
backwards from where it was parked, fatally striking her. The employer did
not ensure
the bulldozer's parking brake system was properly maintained or adjusted
and that it was
capable of holding the equipment in place when parked.
Among other methods, a feasible and acceptable method of abatement is to
ensure that
the braking system is inspected and maintained in accordance with the
manufacturer's
recommendations and that the blade of the dozer is parked on the ground
prior to the
operator exiting the cab.
