Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by heavy equipment: (a) Front loader operators were utilizing a Catapillar 950 to move sand and gravel to the hopper for the manufacture of concrete. The Catapillar 950 was not removed and/or taken out of service until appropriate repairs could be made. The braking system was not operating properly. Among other methods, one feasible and acceptable method of abatement would be to: (a) Have repairs made to the front loader by a mechanic to ensure its safe operation. (Hydraulic braking system) (b) Ensure the braking system is inspected and maintained in accordance with manufacture's recommendation. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
