Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall hazards and other serious hazards from elevating personnel:
a. On or about May 10, 2004-at the above addressed jobsite employees
elevated approximately
thirty (30) feet, from a Lull Model 8444-42 rough terrain fork truck were
exposed to injuries
from falls.  One means of feasible and acceptable method to correct this
hazard is with the
requirement set forth by the American National Standards Institute (ANSI
B56.6-2002) Standard
for Rough Terrain Forklift Trucks.
