Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a. On or about October 12, 2004 - at the above addressed jobsite,
employees were exposed to
the hazard of being struck by falling loads during use of a below-the-hook
lifting device,
CHINBRO 15 ton beam clamp, while installing a beam on a bridge column.
Periodic
inspections of the below-the-hook lifting device were not performed.  One
feasible and
acceptable abatement method, among others, to correct this hazard would be
to conduct Periodic
Inspections of the lifting device for wear, loose parts, and malfunction,
and establish a
maintenance program in accordance with the American Society of Mechanical
Engineers
(ASME) B30.20-1999 standard for Below-The-Hook Lifting Devices, and/or
perform load
testing and recertification of beam clamps every other year as required by
the
Clamp-Co Beam
Clamp Users Manual.
b. On or about October 12, 2004 - at the above addressed jobsite,
employees were exposed to
the hazard of being struck by falling loads during use of a below-the-hook
lifting device,
CHINBRO 15 ton beam clamp, while installing a beam on a bridge column.
The beam clamp
and/or the load was allowed to come in contact with the bridge column.
One feasible and
acceptable abatement method, among others, to correct the hazard would be
to comply with the
ASME B30.20-1999 standard for Below-The-Hook Lifting Devices which states
"do not allow
the load or lifter to come into contact with any obstruction" and/or the
Clamp-Co Beam Clamp
Users Manual which requires that the load and/or beam clamp not strike
anything during a lift.
