employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a. On or about August 24, 2004 - at the above addressed jobsite, an
employee using hand signals
while landing an Upright Model MX 19 Scissors Lift, which was being lift
by a Gradall 534D-
42 rough terrain industrial truck, on the Second Floor was exposed to
being struck by the
scissors lift.  One feasible and acceptable abatement method, among
others, to correct this
hazard would be to follow the Operators Manual for the Gradall 534D, which
states that hand
signals shall be provided or posted for the use of the signalmen.
