Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a.  Employees were exposed to being struck by the counterweight of the
excavator.  Employees
were working in close proximity to an excavator during trenching
operations that were not
protected by safety barriers from the counterweights.
Among feasible means of abatement would be to comply with the Equipment
Manufacturers
Institute Safety manual and require employees to mark off the swing radius
every time
excavators are used.
NOTE:  29 CFR 1903.19 REQUIRES THAT YOU PROVIDE CERTIFICATION AND
DOCUMENTATION OF ABATEMENT FOR THIS ITEM.
