Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employeees in that
employees were exposed to:
Refrigerating Machinery Room: On or about October 21, 2004, employees were
exposed to
hazards arising from the employer's non-compliance with the prescribed
safety requirements
of the ANSI/ASHRAE Standard 15-2001, "Safety Standard for Refrigeration
Systems", or of
an equivalent recognized and generally accepted standard.
Specifically:
a. The employer's machinery room ammonia alarm did not annunciate visual
and audible
alarms inside the refrigerating machinery room as well as outside each
entrance to the room.
b. The refrigerating machinery room ammonia alarm did not have a manual
reset located
inside the room.
c. Doors to the refrigerating machinery room were not marked, or permanent
signs posted,
indicating that access is restricted to authorized personnel.
d. A schematic was not provided, at a location convenient to the operation
of the
refrigeration system, giving directions for the operation of the system.
e. Emergency shutdown procedures, including precautions to be observed in
case of a
breakdown or leak, were not posted outisde the refrigerating machninery
room, immediately
adjacent to each door.
