Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about February 2, 2005 - at the above addressed jobsite, an employee performing masonry operations from a platform (pallet) on the forks of a LULL, Model Number 644E 42, rough terrain forklift truck was exposed to fall and struck by hazards associated with an elevated rough terrain forklift being left unattended in that an operator was not present to operate the controls and/or the platform was not equipped with controls. One feasible and acceptable abatement method, among others, would be to comply with the ASME/ANSI B56.6-2002 Safety Standard for Rough Terrain forklift trucks, which requires a trained operator to be in position to control the rough terrain forklift truck.ft
