Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
Refrigerating Machinery Room:
On or about November 04, 2004, employees were exposed to hazards arising
from the
employer's non-compliance with the prescribed safeguards of the
ANSI/ASHRAE Standard
15-2001, "Safety Standard for Refrigeration Systems", or of an equivalent
and generally
accepted standard.
Specifically:
a. The refrigerating machinery room ammonia alarm did not have a manual
reset located
inside the room. (ANSI/ASHRAE 8.11.2.1)
b. Two of the machinery room doors opened inwards instead of outwards.

c. Employer had no information concerning the capability of the machinery
room mechanical
ventilation system to exhaust an accumulation of refrigerant due to leaks
or a rupture of the
system in accord with the minimum requirements as prescribed by the
ANSI/ASHRAE
Standard, or equivalent. (ANSI/ASHRAE 8.11.5)
d. A schematic was not provided, at a location convenient to the operation
of the
refrigeration system, giving directions for the operation of the system.

e. Emergency shutdown procedures, including precautions to be observed in
case of a
breakdown or leak, were not posted outside the refrigerating machinery
room, immediately
adjacent to each door. (ANSI/ASHRAE 11.7)
