Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls: (a)On or about 03-11-04 at Baumann Coating Inc., the employer allowed an employee to stand on the forks (tines) of a Hyster 250 Serial Number 007002548T forklift and to work from the elevated forks (tines) at a elevated height of 8 - 9 feet above the ground. Among other methods, one feasible and acceptable method to correct this hazard is with the requirements of the American Society of Mechanical Engineers Standards B56.1-1993, Section 4 Safety Standards for Low Lift and High Lift Trucks and/or a work platform designed for this type of work.
