Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: An employee was exposed to a fall hazard when standing on the top rung of a step ladder. One possible means of abatement would be to comply with the ladder muanfacturer's printed instructions on the ladder which state in part: "DANGER" (In black and white and red)"Do not stand on or above this step - YOU CAN LOSE YOUR BALANCE" (This notice is posted on the top step of the ladder).
