Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall of 19 feet while working from a forklift platform: (a) At 322 26th Street North, Bismarck, ND, where an employee was working from an elevated forklift platform that did not have standard railings or other means of fall protection. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a personnel platform which complies with ASME B56.6-1992 Safety Standard for Rough Terrain Forklift Trucks, paragraphs 5.15 and 8.25. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter").tion
