Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a). At the jobsite, an employee was exposed to a struck by hazard in that the employee was permitted to ride as a passenger in the bucket of the skid steer loader. The employer did not prohibit the practice of employees riding in the bucket of a skid-steer loader. One feasible means of abatement to correct this hazard is to comply with the manufacturer's recommendations which state, "Do not allow passengers to ride on the loader at any time." Violation observed on or about 02/10/04. "ABATEMENT VERIFICATION REQUIRED"ION
